a subsidiary of The Shaw Group Inc. (NYSE: SGR) andits construction contract with JH Kelly LLC to increase the scopeof work under each contract for the completion of a 3500 metric tonsper year polysilicon production plant. The agreements as previouslyamended provided for the engineering procurement and constructionof a 2500 metric tons per year polysilicon plant. The change orders establish a $390 million target cost of theproject including $145 million for construction services andmaterials provided by JH Kelly which is below Hoku's previouslydisclosed estimate of $400 million. Shaw and JH Kelly are entitled to bonus payments if their respectivecost targets are achieved. In addition Shaw and JH Kelly are eacheligible to receive additional bonus payments for achieving any often specific schedule milestones beginning with the pilot productionof polysilicon in the fourth quarter of 2008 and ending with thefinal completion of the plant in September 2009. The eight interimmilestones include mechanical and substantial completion of thetrichlorosilane production process the polysilicon depositionreactors and converters the vent gas recovery systems and thebalance of plant and utilities at various stages from January throughSeptember 2009 to allow operations customer shipments and productionramp-up beginning in the first half of 2009.

The Khushab heavy water plant which is under military control was shut down at the time for annual maintenance said a statement from the Pakistan Atomic Energy Commission which evacuated the facility. It said there was no risk to the public outside the sprawling facility southeast of the capital Islamabad. “All necessary steps were taken” the statement said adding that the situation “was immediately brought under control. ” Police near the facility say they were advised by plant officials to prepare buses for a wider evacuation then were told they would not be needed. The commission said the leaking gas was burned off by plant equipment… Pakistan which carried out nuclear tests in 1998 to match those by archrival India has a fairly safe nuclear safety record. But some minor incidents have occurred in recent years. In 2003 one laboratory worker was killed and another man injured in an explosion in a liquid nitrogen tank at the Pakistan Institute of Engineering and Applied Sciences near Islamabad. The scientist training facility where the blast occurred is run by the Pakistan Atomic Energy Commission. An official earlier yesterday said the command and control system for the country’s nuclear weapons would stay unchanged under the new government made up of opponents of President Pervez Musharraf. Pakistan’s nuclear arsenal is overseen by a National Command Authority (NCA) headed by the president and with the prime minister as its vice chairman.

A plant was located purchased and transported to the Escala Mine. The plant will provide Escala a limited on-site processing capabilitywithin the month. Initially the plant will perform production testshelpful to Franklin’s engineer in designing Part III’s permanent processingfacility. The permanent plan is to be located near Escala Mina probably inthe Uyuni area. Part II authorized the immediate expansion of Franklin’s processingfacility in the Alto area of La Paz. Expanding the plant to its full 100ton per day capacity will be accomplished incrementally while continuing toprovide processing capacity to local independent operators. Expanding theAlto area plant provides processing capacity dedicated to the Escala’sproduction until Part III’s permanent facility is complete.
